Florida Chapter 720 is the Florida Homeowners' Association Act — the statute governing HOA formation, governance, covenant enforcement, and assessments.
Chapter 720 governs Florida HOAs the way Chapter 718 governs condominiums. It covers covenant enforcement, assessment collection, board elections, meetings, financial transparency, architectural review disputes, and the special anti-SLAPP protections under § 720.304(4) for owners who criticize boards.
Chapter 720 is less prescriptive than Chapter 718 — HOAs have more flexibility in their governing documents — but still imposes detailed procedural requirements. The fee-shifting provisions in § 720.305 make litigation against an HOA expensive for owners who lose, which shapes settlement dynamics.
