Article 13A (Alabama Builders' Article)
Article 13A is the Alabama statute (Ala. Code §§ 6-5-220 et seq.) governing claims against builders — including a seven-year statute of repose for most construction-defect claims.
Article 13A controls Alabama claims against builders, contractors, and design professionals. Its most consequential feature is the seven-year statute of repose: most construction-defect claims must be brought within seven years of substantial completion, regardless of when the defect was discovered.
The repose period is hard-edged and often dispositive. Combined with Alabama's discovery-rule overlay, many post-turnover defect claims at Gulf-front condominium towers and master-planned communities turn on whether the substantial-completion date falls inside or outside the repose window.
