Alabama Uniform Condominium Act
The Alabama Uniform Condominium Act (Ala. Code §§ 35-8A-101 et seq.) is Alabama's framework for condominium creation, governance, and unit-owner rights, modeled on the Uniform Condominium Act.
The AUCA governs Alabama condominiums created after its 1991 effective date and provides default rules for declaration, bylaws, board elections, common expenses, assessments, foreclosure, and unit-owner rights. It is comparatively light-touch — Alabama condominiums rely heavily on careful document drafting because the statute leaves more to the documents than Florida's Chapter 718.
Older Alabama condominiums (pre-1991) are governed by the prior Condominium Act unless they elect coverage under the AUCA. Gulf-front towers in Orange Beach and Gulf Shores typically fall under the AUCA, while some older structures may not.
